Theoretical and Methodological Principles for the Preservation of Cultural Heritage
Abstract
The article offers a comprehensive analysis of the theoretical and methodological foundations of cultural heritage preservation as an interdisciplinary scholarly problem and a coherent international legal system. The aim of the study is to systematise the conceptual apparatus, normative framework and institutional mechanisms of cultural heritage protection as they have developed in international law from the nineteenth to the 19-21 century. The relevance of the research is underscored by the urgent need for scholarly reflection on the fundamental principles of heritage protection in the context of the large-scale destruction and damage inflicted upon Ukrainian cultural heritage as a result of the armed aggression of the Russian Federation against Ukraine, launched on February 24, 2022. The problem acquires particular urgency in connection with the need to build an evidentiary basis for future restitution claims and to develop strategies for post-war cultural recovery.
The article traces the evolution of the concept of ‘cultural heritage’ – from an intuitive recognition of the value of historical monuments in Antiquity and the Enlightenment to the contemporary inclusive concept encompassing tangible and intangible, underwater and digital heritage, as well as the notion of ‘living heritage’. The key tendencies of contemporary conceptualisation are identified: the democratisation of the heritage concept, the decolonial reassessment of Eurocentric standards, and the shift of focus from the object to the community as the bearer of living cultural practices.
The international legal framework for cultural heritage protection is systematised, comprising the six UNESCO conventions (1954, 1970, 1972, 2001, 2003, 2005), the regional instruments of the Council of Europe (the Granada, Valletta and Faro Conventions) and soft-law documents – the Venice Charter of 1964, the Nara Document on Authenticity of 1994, and the ICOM Code of Ethics for Museums. The three-tier institutional architecture of heritage protection is characterised: the international level (UNESCO, ICOMOS, ICCROM, ICOM, the International Committee of the Blue Shield), the regional level (the Council of Europe) and the national level (ministries, museums and heritage reserves). Special attention is paid to the transformation of Ukraine’s cultural heritage protection system under the conditions of Russia’s full-scale armed invasion.
The study confirms that the effectiveness of the international system of cultural heritage protection is determined above all by the quality of national institutions that implement international obligations in practice. The absence of robust enforcement mechanisms and the Eurocentrism of cultural value-assessment criteria remain systemic shortcomings of the global normative architecture. For Ukraine, these theoretical and methodological foundations carry not only academic but immediate practical significance.
